State of Emergency (possible Price Gouging)

Gov Newsom announced a State of Emergency (SOE) preemptively for upcoming El Nino weather events: Governor Newsom proclaims state of emergency to bolster statewide El Nino preparedness, protect California | Governor of California

He’s doing this in preparation for what is expected to be a historic El Niño weather season and has directed the state agencies to stage equipment and protect infrastructure and prepare for severe winter weather.

Potential for Price Gouging – On paragraph 18 of this SOE Newsom expressly suspends the Penal Code section 396 price gouging restrictions for this El Niño event “at this time.”

CSSA’s recommendations:

1. Be prepared for imminent risk of potential damage including flooding, etc.
2. Get your assets ready for possible extreme winter weather events
3. Prepare in event Price Gouging is enacted that includes storage pursuant to penal code

CALIFORNIA CITIES ARE REVISITING BUSINESS LICENSES AND BUSINESS TAX STRUCTURES

Through our monitoring of local issues, CSSA is seeing increased activity by cities across California reviewing and revising their business license programs and business tax structures, including potential increased fee changes. The changes we are seeing is a switch from a traditional flat business tax to a gross receipts tax which can equate to thousands of dollars of increased taxes which will materially impact property values. 

We encourage every self storage operator to monitor what is happening in your city. Check your City Council agendas and minutes regularly for proposed changes to business license fees or requirements.

•  Get involved early—before changes are approved
